Acceptance of Terms

The services that Account360.ai provides to you are subject to the following Terms of Use (“TOU”). Account360.ai reserves the right to update and modify the TOU without your notice. The most current version of the TOU can be reviewed by clicking on the “Terms of Use” hypertext link at the bottom of our Web pages. When we update the TOU, Account360.ai will update the date at the top of this page. By using the website after a new version of the TOU has been posted, you agree to the terms of such a new version.

Description of Services

Through its network of applications, Account360.ai provides you with access to a variety of resources, including tools, download areas, communication forums, and product information (collectively “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new application, are subject to these TOUs.

Organizational Provision and Breach of Contract

Your organization provides you with access to this CRM platform. By using this application, you acknowledge that your use is subject to the terms and policies set forth by both your organization and account360.ai.

Any misuse, unauthorized access, or any form of wrongdoing within this application constitutes a breach of contract. Such actions may result in the following consequences:

1. Disciplinary Action: Your organization may take disciplinary actions against you, which could include suspension or termination of your employment or contractual relationship.
2. Revocation of Access: We reserve the right to revoke your access to the platform immediately upon detecting any breach of contract, without prior notice.
3. Legal Action: You may be subject to legal action by either your organization or us, which could result in financial penalties, damages, or other legal remedies.
4. Liability for Damages: You may be held personally liable for any damages or losses incurred by your organization, us, or third parties as a result of your wrongdoing.

Personal and Non-Commercial Use Limitation

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Services.

Content

All content included in or made available through the Services, such as text, graphics, logos, icons, images, sounds, music, digital downloads, data compilation, software, and documents is the exclusive property of Account360.ai or its content suppliers and is protected by the various applicable trade dress, copyright, trademark, patent, and other intellectual property and unfair competition laws in the United States and internationally. All rights not expressly granted to you in this TOU are reserved and retained by Account360.ai or its licensors, suppliers, publishers, rightsholders, or other content providers.

Software

Any software that is made available to download from the Services (“Software”) is the copyrighted work of Account360.ai and/or its customers/partners. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”). An end user will be unable to install any Software that is accompanied by or includes a License Agreement unless he or she first agrees to the License Agreement terms. Third-party scripts or code, linked to or referenced from this website, are licensed to you by the third parties that own such code, not by Account360.ai.

The Software is made available for download solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not by the License Agreement is expressly prohibited by law and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

Without limiting the foregoing, copying or reproduction of the software to any other server or location for further reproduction or redistribution is expressly prohibited, unless such reproduction or redistribution is expressly permitted by the license agreement accompanying such software.

Documents

Permission to use Documents (such as white papers, press releases, datasheets, and FAQs) from the Services is granted, provided that (1) the below copyright notice appears in all copies and that both the copyright notice and this permission notice appear, (2) unless explicitly covered by another license or agreement, use of such Documents from the Services is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media, and (3) Use for any other purpose is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

Documents specified above do not include the design or layout of the Account360.ai app, website or any other Account360.ai owned, operated, licensed, or controlled site. Elements of Account360.ai app and websites are protected by trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound, or image from any Account360.ai may be copied or retransmitted unless expressly permitted by Account360.ai and/or its customers/partners.

Member Account, Password, and Security

If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete, and accurate information as prompted by the applicable registration form. You also will choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any activities that occur under your account. You agree to notify Account360.ai immediately of any unauthorized use of your account or any other breach of security. Account360.ai will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Account360.ai or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.

No Unlawful or Prohibited Use

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Account360.ai server, or the network(s) connected to any Account360.ai server, or interfere with any other party’s use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems, or networks connected to any Account360.ai server or any of the Services, through hacking, password mining, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services. You may not attempt to copy change, alter, or otherwise attempt to modify the Services or these TOUs.

Fair Usage Policy:

Acceptable Use – General Guidelines

1. Business Purposes: Use the Service for legitimate business purposes related to customer relationship management.
2. Compliance: Ensure your usage complies with all applicable laws, regulations, and this Policy.
3. Respect for Others: Use the Service in a manner that is respectful to others and does not interfere with their use of the Service.

Unacceptable Use

Prohibited Activities

1. Illegal Activities: Do not use the Service for any unlawful purposes, including but not limited to fraud, hacking, or distributing prohibited content.
2. Security Violations: Do not attempt to breach the security of our Service, including unauthorized access, data theft, or any activity that disrupts the integrity of our systems.
3. Spamming: Do not use the Service to send unsolicited messages, spam, or other forms of disruptive communications.
4. Resource Abuse: Do not use the Service in a manner that excessively consumes resources, disrupts the Service for other users, or degrades performance. 
5. Content Restrictions: Do not upload, share, or distribute content that is harmful, offensive, or violates intellectual property rights.

Specific Prohibitions

1. Automated Systems: Do not use automated systems or software to extract data or interfere with the normal functioning of the Service.
2. False Information: Do not provide false information or impersonate others when using the Service.
3. Malware: Do not distribute or introduce viruses, malware, or other harmful software through the Service.
4. Violation: Engaging in or facilitating SQL Injection, XSS, or script-running attacks is a violation of these terms and may result in immediate suspension or termination of your access to the Service. You may also be held liable for any damages or losses incurred due to such activities.

Monitoring and Enforcement

Monitoring

We reserve the right to monitor usage of the Service to ensure compliance with this Policy. This includes but is not limited to:

1. Traffic Analysis: Analyzing traffic patterns and usage statistics.
2. Content Review: Reviewing content shared or distributed through the Service.
3. User Activity: Monitoring user activity to detect potential violations.

Enforcement

Violations of this Policy may result in:

1. Warning: Issuing a warning to the user regarding the violation.
2. Service Restrictions: Temporarily or permanently restricting access to the Service.
3. Termination: Terminating the user’s account and access to the Service.
4. Legal Action: Pursuing legal action against the user for violations of this Policy.

Reporting Violations

If you become aware of any violations of this Policy, please report them to our support team at support@account360.atlassian.net or through our contact form on the Account360.ai website.

Changes to This Policy

We reserve the right to modify this Policy at any time. Changes will be communicated through our website and, where appropriate, directly to users. Continued use of the Service after such changes constitutes acceptance of the new terms.

Use of application upon disengagement with the org

• Breach of Agreement: Continuing to use the application after termination constitutes a breach of the Terms of Service, which may lead to legal action or other remedies available under the law.
• Access Revocation: We reserve the right to revoke access to the platform and any associated services immediately upon termination. Attempts to access the platform post-termination may be blocked and monitored.
• Legal and Financial Liability: You may be held legally and financially responsible for any unauthorized use of the application post-termination, including any damages or losses incurred by us or third parties as a result of such use.
• Please do reach out to us if you are still able to use the application so that we can take necessary actions that are required so that you are not liable for any unauthorized use of the application post-termination, including any damages or losses incurred by us or third parties as a result of such use.

Use of Services

The Services may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets, and/or other message or communication facilities designed to enable you to communicate with others (each a “Communication Service” and collectively “Communication Services”). You agree to use the Communication Services only to post, send, and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using the Communication Services, you will not:

• Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

• Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, obscene, indecent, or unlawful topic, name, material or information.

• Upload, or otherwise make available, files that contain images, photographs, software, or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same.

• Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allow such messages.

• Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.

• Restrict or inhibit any other user from using and enjoying the Communication Services.

• Violate any applicable laws or regulations.

• Use, download, or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Services or other user or usage information or any portion thereof.
